Terms of Service — Mindful Meal Plans

These Terms of Service ("Terms") govern your use of the Mindful Meal Plans mobile application and the web portal at mindfulmealplan.com (together, the "Service"), operated by Mocha's MindLab Inc. ("we," "our," or "us"), a company based in British Columbia, Canada.

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Your account

You need an account to use most of the Service. You are responsible for keeping your sign-in credentials secure and for all activity under your account. You must provide accurate information and be at least 13 years old (or the minimum digital-consent age in your region) to use the Service.

One account works across the iPhone app and the web portal. Household features let you share lists, recipes, and meal plans with people you invite; content shared with a household is visible to its members.

2. Free plan and Pro subscription

The core of the Service is free: shared lists, your recipe library, the meal plan calendar, and household invitations, plus a limited number of free AI tries.

Pro is an auto-renewing subscription (monthly or annual) that unlocks the AI features, including AI recipe imports, AI Chef chats, fridge and pantry scans, and AI meal plan generation. Current pricing is shown at the point of purchase. Prices are set in Canadian dollars; app stores display and charge in your local storefront currency.

Free trial. New subscribers get a free trial (currently 7 days). You can cancel any time before the trial ends and pay nothing.
Renewal and cancellation. Subscriptions renew automatically until cancelled. If you subscribed through the Apple App Store, manage or cancel in your Apple subscription settings. If you subscribed on the web, use the manage link in your receipt email. Cancelling stops future renewals; your Pro access continues until the end of the paid period.
Refunds. Purchases made through the Apple App Store are subject to Apple's refund policies and must be requested from Apple. For web purchases, contact us at mocha@mochasmindlab.com and we will review refund requests in line with applicable consumer protection law.
We may change subscription pricing with reasonable advance notice; changes apply from your next renewal.

3. AI features

Parts of the Service use artificial intelligence to generate recipes, meal plans, and cooking guidance. AI output can be wrong. In particular:

Check ingredients yourself. If you or anyone in your household has an allergy, intolerance, or medical dietary requirement, always verify AI-generated recipes and imported ingredient lists before cooking or eating. The Service's dietary-preference features are conveniences, not safety guarantees.
Not medical advice. The Service is not a medical, nutrition, or dietetic service and does not provide medical advice. Consult a qualified professional for medical or nutritional guidance.
Food safety. Follow safe food handling, storage, and cooking-temperature practices; AI suggestions do not replace them.

4. Your content

You keep ownership of the content you add: recipes, photos, lists, notes, and meal plans. You grant us the limited licence needed to operate the Service: storing your content, syncing it across your devices and household, processing it with AI features you invoke, and displaying it back to you.

When you import a recipe from a website or social media, you are responsible for having the right to save that content for your personal use. The Service's import features are provided for personal, non-commercial use.

You agree not to use the Service to store or share unlawful content, to abuse, probe, or overload the Service or its AI features, to reverse engineer the Service, or to resell it.

5. Our content and the catalog

The Service, including its design, code, brand, and the curated recipe catalog, is owned by us or our licensors and protected by intellectual property law. We grant you a personal, non-transferable licence to use the Service. Catalog recipes you save into your library remain available to you for personal use within the Service.

6. Availability and changes

We work hard to keep the Service running, but it is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We may add, change, or remove features, and we may suspend or terminate accounts that violate these Terms. You can delete your account at any time in the app's settings; deletion permanently removes your personal data as described in the Privacy Policy.

7. Limitation of liability

To the maximum extent permitted by law, Mocha's MindLab Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the Service. Our total liability for any claim is limited to the greater of CA$50 or the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing in these Terms excludes liability that cannot be excluded under the law of your province or country, including rights under Canadian consumer protection legislation.

8. Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Disputes will be resolved in the courts of British Columbia, unless the consumer protection law where you live gives you the right to bring proceedings locally.

9. Changes to these Terms

We may update these Terms from time to time. For material changes we will give notice in the app or by email before the change takes effect. Continuing to use the Service after a change means you accept the updated Terms.
